Privacy Policy for Driver Subscribers

This Privacy Policy (this “Policy”) describes how TriYum LLC (“TriYum,” “Company,” “we,” “us,” or “our”) collects, uses, shares, and protects information provided by or collected from individuals and businesses that subscribe to and use TriYum’s driver-facing software, mobile application, websites, and related services (collectively, the “Driver Platform”).
This Policy applies only to Driver Subscribers. If you interact with TriYum in another capacity, such as a consumer placing an order or a merchant using TriYum services, please refer to the privacy policy applicable to that relationship.
1. INFORMATION WE COLLECT
We may collect information you provide directly to us, information collected through your use of the Driver Platform, and information we receive from third-party service providers involved in operating the Driver Platform.
A. Information You Provide to Us
When you register, subscribe, apply for access, communicate with us, or otherwise use the Driver Platform, we may collect information such as:
- your name;
- business name, if applicable;
- mailing address;
- email address;
- telephone number;
- username and password or other account credentials;
- date of birth;
- driver’s license information;
- vehicle registration information;
- proof of insurance;
- service area, language, account preferences, and similar profile information; and
- information you provide when contacting us for support or communicating with us through the Driver Platform.
TriYum may collect photographs or images of Driver Subscribers, including profile photos or images contained in identification documents, where needed for account setup, verification, eligibility, safety, account integrity, or customer delivery notifications where required by law.TriYum does not collect biometric identifiers such as facial scans, face geometry, biometric templates, fingerprints, or voiceprints through the Driver Platform. TriYum also does not collect selfies for identity verification.
B. Information Collected Through Use of the Driver Platform
When you visit, access, or use the Driver Platform, we may collect certain technical and usage information, including:
- IP address;
- browser type;
- operating system;
- mobile device type;
- app or software version;
- log files and diagnostic information;
- pages, screens, or features viewed or used;
- dates and times of access; and
- crash reports, performance data, and related technical information.
C. Location and Navigation Information
TriYum does not collect precise geolocation through the Driver Platform and does not provide real-time customer tracking through the Driver Platform.
TriYum may support driver routing and navigation through a connected maps application and may use related information to support platform functionality, safety, and fraud prevention.
If you do not allow a connected maps application or your device to use location services, some routing or navigation-related functions may be unavailable or may not function as intended.
D. Transaction and Delivery Activity Information
We may collect information relating to your activity on the Driver Platform, including:
- account registration and account status information;
- delivery-related workflow information;
- order and transaction records;
- records relevant to disputes, support issues, or account reviews; and
- information necessary to facilitate the operation of the Driver Platform.
We may also maintain information necessary to support customer delivery, notifications and legally required delivery-status disclosures. This may include profile information, such as a driver’s first name and picture, used to support order-status notifications and customer-facing disclosures required by law.
E. Information from Third Parties
We may receive information about you from third parties involved in operating the Driver Platform, including:
- identity verification providers;
- background screening providers;
- mapping or navigation providers;
- communications and customer support providers;
- cloud hosting providers;
- fraud prevention and security providers; and
- merchants, restaurants, customers, or business partners involved in transactions or disputes.
TriYum may use third-party providers such as Austin Investigation for identity verification, Stripe for payment processing, a connected maps application for navigation, Keap and Apollo for communications and outreach, Issuetrak for support and related functions, and Him First Media for hosting.
2. HOW WE COLLECT YOUR INFORMATION
We collect information in several ways.
A. Information You Provide Directly
We collect information you provide to us when you:
- create an account;
- subscribe to or apply to use the Driver Platform;
- upload documents or complete onboarding steps;
- request support, services, or information from us; or
- communicate with us by email, phone, text, chat, or other means.
If you provide information through a third-party site, service, or platform, that third party may also collect the information you provide, subject to its own privacy practices.
B. Platform and Technical Collection
As you enter or use the Driver Platform, we may capture and retain technical information associated with your access to the Driver Platform, including device and system information reasonably necessary to operate, secure, and maintain the Driver Platform.
C. Communications and Related Platforms
If you request support, sign up for future communications, or otherwise interact with TriYum through connected communications or support platforms, information you provide may be processed through those platforms.
3. WHAT WE DO WITH YOUR INFORMATION
We may use your information for the following purposes:
A. To Provide and Operate the Driver Platform
- create, maintain, and administer your account;
- authenticate users and allow access to the Driver Platform;
- facilitate delivery-related platform functions;
- support routing and navigation through connected tools;
- provide customers with delivery-status information and driver-identifying information where required by applicable law; and
- maintain records relating to use of the Driver Platform.
B. To Verify Identity, Eligibility, and Safety
- verify your identity and account information;
- review onboarding materials;
- facilitate identity verification and related eligibility checks through service providers;
- support platform safety, trust, and account integrity; and
- address fraud prevention and related security concerns.
C. To Communicate With You
- contact you regarding your account, subscription, or support requests;
- send service notices, security alerts, updates, and administrative messages;
- communicate with you about features, functionality, or changes to the Driver Platform; and
- send marketing or promotional communications, subject to your choices and applicable law.
D. To Protect Rights, Safety, and Security
- protect TriYum, Driver Subscribers, merchants, and the public;
- detect, investigate, and prevent fraud, abuse, or unauthorized access;
- enforce our agreements, terms, and policies; and
- investigate complaints, incidents, disputes, or suspected misconduct.
E. For Legal and Compliance Purposes
- comply with legal, tax, accounting, regulatory, and recordkeeping obligations;
- respond to subpoenas, court orders, legal process, or lawful government requests; and
- establish, exercise, or defend legal claims.
F. With Your Consent or Direction
- for any other purpose disclosed at the time of collection; or
- with your consent or at your direction.
4. SHARING YOUR INFORMATION
Information about our users is important to us. We do not sell personal information for money and do not share personal information for cross-context behavioral advertising.
We may share information as described below.
A. Service Providers
We may share information with third-party service providers or contractors that perform services on our behalf, such as:
- payment processing;
- identity verification and screening;
- hosting, storage, and cloud services;
- customer support and communications;
- fraud prevention and security; and
- mapping, routing, and technical support.
These service providers may access personal information only as needed to perform services for us and for other permitted purposes consistent with applicable law.
B. Merchants and Other Transaction Participants
We may share limited information with restaurants, customers, and other transaction participants when necessary to facilitate deliveries and related Driver Platform functions. For example, TriYum may share a driver’s first and last name with a restaurant in connection with an order.
Where required by applicable law, TriYum may also provide the customer, through the Driver Platform, with the driver’s first name and picture when the order is out for delivery.
Except as otherwise required by law or necessary to operate the Driver Platform, TriYum does not share driver vehicle details, phone numbers, or real-time location with customers through the Driver Platform.
C. Affiliates and Corporate Transactions
We may share information with our affiliates for internal business, operational, administrative, and security purposes.
If TriYum or any portion of its assets is acquired, merged, reorganized, financed, sold, or transferred, your information may be disclosed or transferred as part of that transaction.
D. At Your Direction
We may share your information with third parties when you direct us to do so, such as when you choose to connect third-party tools or services to your account.
E. Legal Process and Protection
We may disclose information as required by law or as reasonably necessary to:
- comply with legal obligations or legal process;
- respond to lawful requests from courts, regulators, or law enforcement;
- enforce our agreements or policies;
- protect the rights, property, or safety of TriYum, our users, or others; or
- detect, investigate, or prevent unlawful, fraudulent, abusive, or harmful activity.
5. YOUR CONTROLS AND CHOICES
We provide you with certain controls and choices regarding the collection, use, and sharing of your information.
Depending on the Driver Platform’s features and applicable law, you may be able to:
- access, review, correct, or update account information;
- change your preferences for alerts or communications;
- opt out of promotional emails by using the unsubscribe link in those messages;
- request access to, correction of, or deletion of certain personal information we hold about you, subject to applicable law; and
- request account closure, subject to our need to retain certain information for legal, security, accounting, or operational reasons.
Please note that if you do not allow us to collect or process certain information, we may not be able to provide some features or functions of the Driver Platform.
6. SECURITY MEASURES
The security, integrity, and confidentiality of your information are important to us. We use reasonable administrative, technical, and physical safeguards designed to protect personal information.
Please be aware, however, that no security measures are perfect or impenetrable, and we cannot guarantee absolute security.
You are responsible for maintaining the confidentiality of your account credentials and notifying us promptly if you believe your account has been compromised.
7. HOW WE COMMUNICATE WITH YOU
We may communicate with you by email, telephone, text message, push notification, in-app message, or mail regarding:
- your account or subscription;
- transactions or delivery activity;
- support issues;
- platform updates;
- policy changes;
- security matters; and
- marketing or promotional communications, where permitted.

8. CHILDREN
The Driver Platform is not directed to children, and Driver Subscriber accounts are not intended for individuals under 18 years of age.
We do not knowingly collect personal information from children under 13 in connection with the Driver Platform. If we learn that we have collected personal information from a child under 13 without appropriate authorization, we will take reasonable steps to delete that information.
9. CHANGES TO THIS POLICY
From time to time, we may change this Policy to reflect new technologies, legal requirements, industry practices, or changes to the Driver Platform.
If we make material changes, we will update the “Last Updated” date above and provide additional notice where required by applicable law.
10. NOTICE TO CALIFORNIA RESIDENTS
If you are a California resident, California law may provide you with certain rights regarding your personal information, subject to applicable exceptions and verification requirements.
A. Categories of Personal Information We May Collect
Depending on how you interact with the Driver Platform, we may collect the following categories of personal information:
- identifiers and contact information;
- customer records information;
- commercial information;
- internet or other electronic network activity information;
- professional or business-related information, where applicable
- visual information, where applicable, such as identification document images or driver profile photographs; and
- sensitive personal information, where applicable, such as driver’s license information and account log-in credentials combined with a password or other access code.
We collect this information for the purposes described in Section 3 of this Policy.
B. Your California Privacy Rights
Subject to applicable law and verification requirements, California residents may have the right to:
- know the categories of personal information we collect, use, disclose, or otherwise process;
- access specific pieces of personal information we have collected about them;
- request deletion of personal information we collected from them;
- request correction of inaccurate personal information we maintain about them;
- opt out of the sale or sharing of personal information, if applicable;
- limit the use and disclosure of sensitive personal information, if applicable; and
- not receive discriminatory treatment for exercising privacy rights.

We may need to verify your identity before processing certain requests. You may also designate an authorized agent to make a request on your behalf, subject to applicable verification requirements.
We generally respond to verified consumer requests within 45 days, although we may extend the response period as permitted by law.
C. Sale or Sharing of Personal Information
TriYum does not sell or share personal information as those terms are defined under California law.
D. Sensitive Personal Information
TriYum uses sensitive personal information only as reasonably necessary for account administration, identity verification, safety and security, fraud prevention, legal compliance, and providing the Driver Platform.
If California law gives you the right to limit certain uses or disclosures of sensitive personal information, you may exercise that right using the methods identified in Section 14.
E. Shine the Light
California Civil Code section 1798.83 may permit California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. If applicable, such requests may be submitted using the contact information in Section 14.
11. CALIFORNIA DO NOT TRACK AND PRIVACY PREFERENCE SIGNALS
Some browsers offer a “Do Not Track” setting. Because there is not a uniform industry standard for Do Not Track signals, our websites may not respond to those signals in all contexts.
If TriYum is required by applicable law to recognize browser-based opt-out preference signals, such as the Global Privacy Control, we will process such signals in accordance with applicable law.
12. DATA RETENTION
We retain personal information for as long as reasonably necessary for the purposes described in this Policy, including to:
- provide the Driver Platform;
- maintain business and transaction records;
- comply with legal, accounting, tax, and regulatory obligations;
- resolve disputes;
- enforce agreements and policies; and
- protect against fraud, misuse, or security incidents.
Retention periods may vary depending on the type of information and the reason it was collected.
We may retain identified or aggregated information for longer periods or indefinitely, to the extent permitted by law.
13. INTERNATIONAL USE
TriYum is based in the United States, and personal information may be collected, processed, stored, and transferred in the United States or other jurisdictions where we or our service providers operate.
By using the Driver Platform, you understand that your information may be transferred to jurisdictions that may have different data protection laws than those in your location.
